1. Off-Specification Paraformaldehyde Meets Commercial Chemical
Product Listing
A manufacturer stores product formaldehyde (CAS No. 50-00-0) in
containers before use in a manufacturing process. While in storage,
some of the pure formaldehyde polymerizes to form paraformaldehyde
(CAS No. 30525-89-4), which is unusable in the manufacturing process
because it does not meet required specifications. The manufacturer
separates the paraformaldehyde from the usable formaldehyde and sends
the off-specification chemical for disposal. Unused commercial
chemical products containing formaldehyde are listed as U122 when
discarded (40 CFR 261.33(f)). Paraformaldehyde is not found on the
P- or U-list (40 CFR 261.33 (e) or (f)). When discarded, is the
off-specification paraformaldehyde a listed hazardous waste?
In the above scenario, paraformaldehyde is an off-specification
form of formaldehyde and meets the U122 listing (40 CFR 261.33(b)).
When a commercial chemical product listed in 261.33(e) or (f)
undergoes a chemical change that renders the chemical off-
specification, the applicable P- or U-listing for the original
chemical applies, even in cases where the chemical composition has
changed sufficiently to require assignment of a different CAS Number.
EPCRA
2. Aquaculture Exemption for EPCRA 311 and 312
EPCRA 311 and 312 require facility owners or operators to
submit Material Safety Data Sheets (MSDSs) and annual inventory
reports for any hazardous chemical subject to OSHA⺳ Hazard
Communication Standard (29 CFR 1910.1200(c)) which is present at a
facility above a reportable threshold (40 CFR 370.20(b)). An owner
or operator does not have to count toward threshold determinations
the amount of a chemical exempt from the definition of a hazardous
chemical under EPCRA 311(e) and 40 CFR 370.2. Pursuant to 40 CFR
370.2, any substance used in routine agricultural operations is
exempt from the definition of hazardous chemical and therefore is not
included in threshold determinations for reporting purposes. Would
this agricultural exemption apply to chemicals used for fish farming
(i.e., aquaculture)?
As defined by the National Aquaculture Act of 1980 in 16 U.S.C.
2802(1), aquaculture involves the propagation and rearing of aquatic
species in controlled or selected environments, including, but not
limited to, ocean ranching. The agricultural exemption under EPCRA
311 and 312 applies to a wide range of growing operations including
livestock production, nurseries, and other horticultural operations
(52 FR 38344, October 15, 1987). Because aquaculture involves
livestock and vegetation production, EPA considers it a type of
agriculture, and thus the chemicals used for growing and breeding
fish and aquatic plants in an aquacultural operation are excluded
from EPCRA 311 and 312 reporting requirements.

exports of hazardous wastes, municipal wastes, and municipal
incinerator ash. This fact sheet provides a brief background of the
main issues and announces the current Agency policies and

wastes. It also discusses existing international agreements for
transboundary movements of hazardous wastes.

consists of copies of the report request forms, the second provides
an index of report topics, and the third is a summary of information
found in each report and a sample report page. The catalogue
explains how to make a report request and provides options for
customizing reports.

package proposes to reduce the intensiveness of the final step in the

Isocyanate (MIC)"

information about the facilities that handle MIC.

spills. Using the March 1989, Exxon Valdez spill as an example,

TITLE: "ROD Annual Report: Fiscal Year 1992"

The Records of Decision (RODs) highlighted in this annual report
document compliance with SARA mandates for the remedial program for
FY 1992. Each ROD discusses the remedy decision for a site or
operable unit, certifies that the remedy selection process has
followed the requirements of CERCLA and the National Contingency Plan
(NCP), discusses the major technical components of the remedy, and
provides the public with a consolidated source of information about
the site.
TITLE: "Superfund Program Implementation Manual Fiscal Year 1994,
Volume 1 & Volume 2"

This two volume set provides guidance on the management of the
Superfund program for information management coordinators, regional

concerning site screening and assessment and the regional decision
team; early- and long-term actions; enforcement; federal facilities;

TITLE: "Use of IRIS Values in Superfund Risk Assessment"

This memorandum clarifies the Agency's policy on the use of
Integrated Risk Information System (IRIS) values in performing health
risk assessments. IRIS is a database that contains health, risk
assessment, and EPA regulatory information on some 400 chemicals.
Decision makers are advised to use IRIS where appropriate.
TITLE: "Fiscal Year 1994 Superfund Program Priorities"

Accident Safety: Report to Congress 112(r)(10) Clean Air Act as
Amended"

Section 112(r)(10) of the 1990 Clean Air Act Amendments requires a
review of federal agency authorities and coordination
responsibilities for release prevention, mitigation, and response.
To fulfill this Congressional mandate, the Chemical Emergency
Preparedness and Prevention Office of EPA and the National Response
Team prepared this document which describes the current federal
safety system, contingency planning provisions, and emergency
response issues.

"Degradable Plastic Ring Rule"
March 1, 1994 (59 FR 9866)
EPA issued a final rule in response to Public Law 100-556,
"Degradable Plastic Ring Carriers," which provides that EPA shall
require plastic ring carriers be made of degradable material. This
rule is effective September 1, 1994.
"Identification and Listing of Hazardous Waste; Recycled Used Oil
Management Standards"
March 4, 1994 (59 FR 10550)
EPA clarified and expanded standards for the management of
recycled used oil, which were originally published in the Federal
Register on September 10, 1992 (57 FR 41566). The rule is effective
April 4, 1994.
"Mississippi; Final Authorization of Revisions to State Hazardous
Waste Management Program"
March 18, 1994 (59 FR 12857)
EPA intends to approve Mississippi's hazardous waste program
revisions under RCRA. Final authorization will be effective May 17,
1994, unless EPA publishes a prior action withdrawing this immediate
final rule. Comments must be received on or before April 18, 1994.
"Standards for Owners and Operators of Hazardous Waste Treatment,
Storage and Disposal Facilities (TSDFs); Recordkeeping Instructions"
March 24, 1994 (59 FR 13891)
EPA amended recordkeeping instructions for owners and operators
of hazardous waste TSDFs. The amendment will encourage the
consistent recordkeeping and reporting of information by hazardous
waste TSDFs. This rule is effective March 24, 1994.

"Class II Civil Penalties Under CERCLA and the Federal Water
Pollution Control Act (FWPCA)"

The Coast Guard issued final regulations addressing practice and
procedure for cases assessing Class II civil penalties under FWPCA
311(b) and CERCLA 109. This rule is effective March 30, 1994.
CERCLA/DOI
"Natural Resource Damage Assessments"
March 25, 1994 (59 FR 14262)
DOI amended regulations for assessing natural resource damages
resulting from a Clean Water Act discharge of oil into navigable
waters, or a CERCLA release. The Department will soon issue a new
proposed rule to address assessment of lost nonuse values of injured
resources. This rule is effective April 25, 1994.

EPA proposed to grant a petition submitted by Bethlehem Steel
Corporation, of Sparrows Point, Maryland, to exclude certain solid
wastes generated at its facility from the lists of hazardous wastes
at 40 CFR 261.31 and 261.32. Comments must be submitted on or
before April 18, 1994.
"Washington; Final Authorization of Revisions to State Hazardous
Waste Management Program"

EPA intends to approve Washington's hazardous waste program
revisions under RCRA pending public review and comment. A public
hearing is scheduled for April 28, 1994. Comments must be submitted
on or before April 29, 1994.

"Carbamate Production Identification and Listing of Hazardous Waste"
March 1, 1994 (59 FR 9808)
EPA proposed to amend the regulations for hazardous waste
management under RCRA by listing as hazardous six wastes generated
during the production of carbamates. The Agency is also proposing to
add four generic groups and 70 specific chemicals to the list of
commercial chemical products that are hazardous wastes when
discarded. These wastes proposed for listing as hazardous waste are
also proposed to be listed as CERCLA hazardous substances. Comments
must be submitted on or before May 2, 1994.

Pursuant to RCRA 4005(c)(1)(C), EPA gave notice of a final
determination of partial program adequacy for Alabama's municipal
solid waste landfill permit program. The determination of adequacy
is effective March 2, 1994.

Waste Permit Program"

Pursuant to RCRA 4005(c)(1)(C), EPA gave notice of a tentative
determination, public hearing, and public comment period concerning
the adequacy of Florida's municipal solid waste landfill permit
program. The public hearing is scheduled for April 25, 1994.

EPA clarified portions of the proposed rule of September 14, 1993
(58 FR 48092), which concerns land disposal restrictions. EPA
decided not to include the "contained in" policy as part of the
proposal, but to address this policy as part of the Hazardous Waste
Identification Rule. Comments must be submitted on or before March
15, 1994.
"Michigan; Final Determination of Adequacy of State/Tribal Municipal
Solid Waste Permit Program"

Pursuant to RCRA 4005(c)(1)(C), EPA gave notice of a final
determination of partial program adequacy for Michigan's municipal
solid waste landfill permit program. The determination of adequacy
is effective March 10, 1994.
"Consent Decree; Big Muddy Oil Processors"

A Consent Decree in United States v. Dale Valentine, et al., was
lodged with the U.S. District Court for the District of Wyoming on
March 4, 1994. The decree requires the defendants to pay a civil
penalty of $300,000 for RCRA violations at the abandoned Big Muddy
Oil Processors Site in Glenrock, Wyoming. Comments will be received
for a period of 30 days from the date of publication.
"Draft Waste Minimization and Combustion Strategy; Public Meetings"
March 11, 1994 (59 FR 11599)
EPA gave notice of a series of one-day regional roundtable
discussions on the Draft Hazardous Waste Minimization and Combustion
Strategy. Four meetings in four cites are scheduled, beginning in
San Francisco on April 16, 1994.

Waste Permit Program"

A Consent Decree in United States v. Cablec Continental Cables
Company was lodged with U.S. District Court for the Northern District

"Risk Management Programs (RMPs) for Chemical Accidental Release

with flammable substances used as fuel and the appropriateness of the
exemption pursuant to the RMPs proposed rule of October 20, 1993 (58

"Kansas; Approval of State Underground Storage Tank (UST) Program"

EPA intends to approve Kansas' UST program. EPA expects to make a

"Administrative Settlement; Idaho Pole Company Site"

EPA proposed to enter into an administrative settlement under
CERCLA 122(i). The settlement requires the settling parties to
reimburse EPA $2,193,578 for costs incurred in connection with the
Idaho Pole Company Site in Bozemon, Montana. Comments must be
submitted on or before March 31, 1994.
"National Priorities List; Revere Textile Prints Corporation Site"

EPA intends to delete the Revere Textile Prints Corporation Site
in Sterling, Connecticut, from the National Priorities List. This
action is being taken because EPA and the State of Connecticut
determined that no further cleanup under CERCLA is appropriate.

"Pine Street Canal Superfund Site Coordinating Council; Public
Meetings"

"Consent Decree; Motor Wheel Disposal Site"

A Consent Decree in United States v. Motor Wheel Corporation et
al., was lodged with the U.S. District Court for the Western
District of Michigan on February 16, 1994. The decree requires the
defendants to perform the remedial action at the Motor Wheel Disposal
Site, as specified in the Record of Decision, and to reimburse EPA
for response costs in connection with the site. Comments will be
received for a period of 30 days from the date of publication.
"Consent Decree; Agrico Chemical Company Site"

A Consent Decree in United States v. Agrico Chemical Company, et
al., was lodged with the U.S. District Court for the Northern
District of Florida on February 15, 1994. The decree requires the
defendants to reimburse EPA $232,907 for response costs incurred in
connection with the Agrico Chemical Company Site in Pensacola,
Florida. The defendants have also agreed to implement the remedy
selected for the site by EPA. Comments will be received for a period
of 30 days from the date of publication.
"Consent Decree; Custom Industrial Services Site"

A Consent Decree in United States v. Alcon Foil Products, et al.,
was lodged with the U.S. District Court for the Eastern District of
Kentucky on February 16, 1994. The decree requires the defendants to
reimburse EPA $125,000 for response costs incurred in connection with
the Custom Industrial Services Site in Lexington, Kentucky. Comments

EPA proposed to enter into a de minimis settlement under CERCLA
122(g). The settlement requires the settling parties to reimburse

A Consent Decree in United States v. Berlin and Farro Liquid
Incineration, Inc., was lodged with the U.S. District Court for the
Eastern District of Michigan on February 25, 1994. The decree
requires the defendants to reimburse EPA $2,576,539 for response
costs incurred in connection with the Berlin and Farro Liquid
Incineration Site in Swartz Creek, Michigan. Comments will be

A Consent Decree in United States v. Olin Corporation was lodged
with the U.S. District Court for the Northern District of Ohio on
March 3, 1994. The decree requires the defendants to reimburse EPA
$1,542,540 in response costs incurred in connection with the Big D
Campground Site in Ashtabula, Ohio. Comments will be received for a
period of 30 days from the date of publication.

A Consent Decree in United States v. Vertac Chemical Corporation,
et al., was lodged with the U.S. District Court for the Eastern
District of Arkansas on February 15, 1994. The decree requires the

connection with the Vertac Site in Jacksonville, Arkansas. Comments

A Consent Decree in United States v. Wedzeb Enterprises, Inc., et
al., was lodged with the U.S. District Court for the Southern
District of Indiana on March 11, 1994. The decree requires the
defendants to reimburse EPA $140,000 for response costs incurred in
connection with the Wedzeb Site in Lebanon, Indiana. Comments will
be received for a period of 30 days from the date of publication.
"Agency for Toxic Substances and Disease Registry (ATSDR);
Availability of Funds"

ATSDR announced the availability of funds for a grant to provide
public health interventions for individuals and community members
living near the Bunker Hill Site in Silver Valley, Idaho.
Approximately $50,000 is available in Fiscal Year 1994 to fund this
project.
"National Priorities List; Wide Beach Development Site"

EPA intends to delete the Wide Beach Development Site from the
National Priorities List. This action is being taken because EPA and
the State of New York have determined that no further cleanup under

The Internal Revenue Service announced that the list of taxable
substances in 4672(a)(3) of the Internal Revenue Code will be
modified to include acetylene black. This modification is
retroactive, effective October 1, 1991.

The Internal Revenue Service announced that the list of taxable
substances in 4672(a)(3) of the Internal Revenue Code will be
modified to include poly (69/31 ethylene/cyclohexylenedimethylene
terephthalate), poly (96.5/3.5 ethylene/cyclohexylenedimethylene),
and poly (98.5/1/5 ethylene/cyclohexylenedimethylene terephthalate).
This modification is retroactive, effective October 1, 1990.

is retroactive, effective April 1, 1991.
