1 NOTICE OF PROPOSED VARIATIONS TO THE AICS FOR CERTAIN LEAD
COMPOUNDS IN INDUSTRIAL SURFACE COATINGS AND INKS
In accordance with section 13A(1) of the Industrial Chemicals (Notification and Assessment)
Act 1989, notice is hereby given that the Director proposes to vary the particulars recorded in
the AICS for certain lead compounds following the findings of the priority existing chemical
assessment on lead compounds in industrial surface coatings and inks. Pursuant to section 13
of the Industrial Chemicals (Notification and Assessment) Act 1989 the manufacture and
importation of certain lead compounds for use in industrial surface coatings and inks and
importation of industrial surface coatings and inks containing these compounds will be
restricted. The relevant chemicals are listed in Table 1.

The AICS will be varied in two stages. Particulars of the proposed variations are:

Stage 1
1. From 1 April 2008, [chemical name and CAS number] must not be imported or
manufactured for use in any industrial surface coating or as a component of industrial
surface coatings at concentrations greater than 0.1%, EXCEPT for use in industrial
surface coatings or in any components of industrial surface coatings for the following
industrial applications:

a. Auto refinish car collision repairs;
b. Commercial vehicle and component building;
c. Commercial vehicle refurbishing and repairs;
d. Aviation building (heavy, general and light); and
e. Aviation refurbishing and repairs.

2. From 1 April 2008, [insert chemical name and CAS number] must not be imported or
manufactured for use in any ink or as a component of inks at concentrations greater
than 0.1%, when intended for industrial uses.


Stage 2
From 1 January 2009, [chemical name and CAS number] must not be imported or
manufactured for use in any industrial surface coating or as a component of
industrial surface coatings at concentrations greater than 0.1%.


The individual AICS entries for each chemical listed in Table 1 will be amended by inclusion
of the above particulars.

Under S 15A of the Act it is an offence to import or manufacture [insert chemical name and
CAS number] for any of the specified purposes.

Persons breaching S 15A are liable to a penalty of 120 penalty units.

In accordance with section 13A(2)(d) of the Industrial Chemicals (Notification and
Assessment) Act 1989, any person may give a statement to the Director by 3 JULY 2007,
giving reasons why the particulars should not be included in the AICS.

Component 4 (XC6170)
Summary Report
Reference No: EX/94 (STD/1196)
Oronite Australia Pty Ltd (ABN: 16 101 548 716) of Level 8, 520 Collins St, Melbourne,
Victoria, 3000 and Mobil Oil Australia (ABN: 88 004 052 984) of 29 Francis St, Yarraville
Victoria, 3013 have submitted standard notification statements in support of their applications
for an assessment certificate for Component 4 (XC6170). The notified chemical is intended to
be used as a lubricant additive. Up to 220 tonnes of the notified chemical will be imported per
annum for each of the first five years.

Since the assessment certificate has been granted for the above notified chemical, Perkal Pty
Ltd (ABN 43 009 283 363) of 14 Beete Street, Welshpool Western Australia 6106, has
submitted a supplementary information statement in support of their application for
extension of the original assessment certificates (No. 2333 and No. 2334, STD/1196)
together with written agreements of the holders of the original certificate Oronite Australia
Pty Ltd and Mobil Oil Australia Pty Ltd. Perkal Pty Ltd will be importing 15 tonnes of the
notified chemical per annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

Based on the available data the notified chemical is classified as hazardous under the NOHSC
Approved Criteria for Classifying Hazardous Substances. The classification and labelling
details are:
R43 ?May cause sensitisation by skin contact

Occupational Health and Safety

There is Low Concern to occupational health and safety under the conditions of the
occupational settings described, based on the expected low exposure.

Public Health

There is High Concern to public health when used as a lubricant additive due to the
hazardous nature and proposed use patterns.


Environmental Effects

On the basis of the PEC/PNEC ratio, the chemical is not considered to pose a risk to the
environment based on its reported use pattern.

RECOMMENDATIONS

Regulatory Controls

Hazard Classification and Labelling

? The Office of the ASCC, Department of Employment and Workplace Relations
(DEWR), should consider the following hazard classification for the notified
chemical:
- R43 May cause sensitisation by skin contact

? The following risk phrases for products/mixtures containing the notified chemical
apply:
- 1% R43 May cause sensitisation by skin contact

? Products containing 1% notified chemical should carry the following warnings on
the label:
- S2 Keep out of reach of children
- S24 Avoid contact with skin
- S36 Wear suitable protective clothing
- S37 Wear suitable gloves

The National Drugs and Poisons Standing Committee (NDPSC) should consider the notified
chemical for listing on the SUSDP.

Control Measures

Occupational Health and Safety

? Employers should implement the following safe practices to minimise occupational
exposure during handling of the notified chemical as introduced:
- Minimise spills and drips
- Where possible, automated processes should be used to reduce worker contact
- Use closed systems for reformulation

? Employers should ensure that the following personal protective equipment is used by
workers to minimise occupational exposure to the notified chemical as introduced and
as diluted for use in the lubricant product:
- Chemical resistant gloves
- Protective clothing
- Safety goggles

Guidance in selection of personal protective equipment can be obtained from Australian,
Australian/New Zealand or other approved standards.

? A copy of the MSDS should be easily accessible to employees.

? If products and mixtures containing the notified chemical are classified as hazardous
to health in accordance with the NOHSC Approved Criteria for Classifying

Hazardous Substances, workplace practices and control procedures consistent with
provisions of State and Territory hazardous substances legislation must be in
operation.

Public Health

? The marketers of lubricants containing 1% or more the notified chemical should
indicate on the product label that the product may cause skin sensitisation (allergic
skin reaction) and that skin contact should be avoided.

Disposal

? The notified chemical should be disposed of by authorised landfill or incineration.

Emergency procedures

? Spills or accidental release of the notified chemical should be handled by preventing
spills entering waterways, using physical containment, followed by absorption onto
inert material (vermiculite, sand etc) and placed into suitable containers for disposal.

Secondary Notification

The Director of Chemicals Notification and Assessment must be notified in writing within 28
days by the notifier, other importer or manufacturer:

Under Section 64(2) of the Act:
- if any of the circumstances listed in the subsection arise.

The Director will then decide whether secondary notification is required.

No additional secondary notification conditions are stipulated.

5 PUBLICATION SUMMARY REPORT
Perfluoroamphiphile in Dynax DX 5011
Summary Report
Reference No: LTD/1285
Kidde Australia Pty Ltd (ABN 68 006 252 428) of 314 Boundary Road, Dingley, VIC, 3172
has submitted a limited notification statement in support of their application for an
assessment certificate for Perfluoroamphiphile in Dynax DX 5011. The notified polymer is
intended to be used as an additive for improving foam stability in aqueous fire fighting foam
concentrates for hydrocarbon fuels. Typical end-users are fire brigades, industrial fire
services and foam fire extinguisher manufacturers. Fire extinguishers will not be used in
home or office environments. Up to one tonne of the notified polymer will be imported per
annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

Based on the available data, the notified polymer is not classified as a hazardous substance in
accordance with the NOHSC Approved Criteria for Classifying Hazardous Substances
(NOHSC 2004).

Once released to the environment the notified polymer will be subject to biotic and abiotic
mechanisms which will overtime, breakdown the polymer. No degradation products or
pathways of the notified polymer have been identified. Perfluorocarboxylic acids and
fluorotelomer sulfonates are potential breakdown products.

In the absence of data on the potential perfluorocarboxylic acid breakdown products, it is
considered that these breakdown products could have a number of systemic toxic effects
including developmental effects. Based on the limited data available the potential breakdown
product 6:2 fluorotelomer sulfonate is not classified as a hazardous substance in accordance
with the NOHSC Approved Criteria for Classifying Hazardous Substances (NOHSC 2004).
However, it is noted that the full toxicological profile of this breakdown product has not been
investigated e.g. carcinogenicity.

Occupational Health and Safety

There is Low Concern to occupational health and safety under the conditions of the
occupational settings described.

Public Health

There is Negligible Concern to public health due to direct exposure to the notified polymer.
Although indirect exposure of the general population to the polymer's degradation products is
expected to be low, long-term potential adverse health effects cannot be ruled out.

Environmental Effects

On the basis of the PEC/PNEC ratio the notified polymer may pose an unacceptable risk to
the environment. However, it is acknowledged this would be a rare event and in most cases

the relevant authorities would erect bunding to prevent releases in this situation. Breakdown
products of the notified polymer are persistent and may build-up and be distributed widely in
the environment.

RECOMMENDATIONS

Regulatory Controls

AICS
?When the notified polymer is added to the Australian Inventory of Chemical
Substances (AICS), it should be annotated with the following condition of use:
- For use only as a class B fire fighting foam for which no suitable and less
hazardous alternatives are available.

Control Measures

Occupational Health and Safety

? Employers should implement the following safe work practices to minimise
occupational exposure during handling of the notified polymer as introduced:
- Avoid contact with skin and eyes

? Employers should ensure that the following personal protective equipment is used by
workers to minimise occupational exposure to the notified polymer as introduced:
- Impervious gloves
- Eye protection

? Employers should ensure that the following personal protective equipment is used by
workers to minimise occupational exposure to the notified polymer/thermal
decomposition products during fire fighting activities.
- Breathing apparatus

Guidance in selection of personal protective equipment can be obtained from Australian,
Australian/New Zealand or other approved standards.

? A copy of the MSDS should be easily accessible to employees.

? If products and mixtures containing the notified polymer are classified as hazardous to
health in accordance with the NOHSC Approved Criteria for Classifying Hazardous
Substances, workplace practices and control procedures consistent with provisions of
State and Territory hazardous substances legislation must be in operation.

Public Health

? The following measures should be taken to minimise public exposure to the notified
polymer and its potential breakdown products:
- Use of the fire fighting foam concentrate containing the notified polymer should
be restricted to only essential uses, for which no suitable and less hazardous
alternatives are available.

- Fire fighting foam concentrate containing the notified polymer should not be used
for fire training purposes to limit environmental release.

Environment

The following control measures should be implemented to minimise environmental exposure
during fire fighting activities with foam concentrate containing the notified polymer:

? Minimise run-off by containment (e.g. bunding) and removal
? If any polymer does reach natural waters, ensure sufficient dilution with water occurs
(up to 100 fold the volume of the lost foam may be needed if this occurs in a country
sewer).

Disposal

? The notified polymer should be disposed of in accordance with the relevant local,
state and federal government regulations and undertaken by a registered chemical
disposal company. Disposal to landfill is acceptable.

Emergency procedures

? Spills/release of the notified polymer should be handled by containing the spill /
stopping the leak if possible (for example, turn the leaking containers leak-side up) or
by bunding for a large spill.
? Place inert absorbent material such as vermiculite, sand or dirt onto spilled material
and recover by vacuuming, shovelling or sweeping and place into a suitable labelled
container for disposal.
? Wash the floor with plenty of water and recover the cleaning water for disposal.
? If large quantities of the polymer enter waterways, contact the Environmental
Protection Authority and the local waste management authority

Secondary Notification

The Director of Chemicals Notification and Assessment must be notified in writing within 28
days by the notifier, other importer or manufacturer:

(1) Under Section 64(1) of the Act; if
- the importation volume exceeds one tonne per annum notified polymer; or
- the polymer has a number-average molecular weight of less than 1000; or
- further information becomes available about the breakdown of the polymer to
perfluoroalkyl moieties and/or their toxicity.
or

(2) Under Section 64(2) of the Act:
- if any of the circumstances listed in the subsection arise.

The Director will then decide whether secondary notification is required. If the importation
volume exceeds one tonne per annum a result for toxicity to algae and information on
potential adsorption to soil should be provided. Data on the biodegradability of the notified
polymer should also be provided.

6 PUBLICATION SUMMARY REPORT
Ucecoat 7849
Summary Report
Reference No: LTD/1301
Cytec Australia Holdings Pty Limited (ABN: 45 081 148 629) of Suite 1, Level 1 Norwest
Quay 21 Solent Circuit Norwest Business Park Baulkham Hills NSW 2153 has submitted a
limited notification statement in support of their application for an assessment certificate for
Polymer in UCECOAT?7849. The notified polymer is intended to be used as a component
of UV-curable coatings for substrates such as wood. The notified polymer will be imported in
200 L stainless steel drums as < 40% active material. It will be transported from the wharf to
the notifier for warehousing before being supplied to paint formulators for formulation into a
paint product. The liquid polymer dispersion will be reformulated into paint products at the
paint manufacturing site and will involve transfer of notified polymer by metered dosing to a
1000 kg stainless steel mixing vessel and mixing the notified polymer and other ingredients
in a sealed vessel fitted with a high-speed mixer. Each batch is to be quality checked and
adjustments made as required. The resultant paint is filtered prior to being dispensed into
20 L closed head drums for supply to customers. Paint products containing the notified
polymer will be warehoused at the paint manufacturer's site in and distributed to end-users.
At the end users site the paint containing the notified polymer is applied to wood boards by
roller coater or automatic spray machine. Up to 100 tonnes of the notified polymer will be
imported per annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

The notified polymer in an aqueous dispersion ( 40%) is a slight skin and eye irritant in
rabbits. No other toxicological data were submitted but the notified polymer is not expected
to be acutely or chronically toxic, a skin sensitiser or genotoxic based on consideration of the
chemical structure.

Occupational Health and Safety

Under the conditions of the occupational settings described, the risk to workers is considered
to be acceptable.

Public Health

When used in the proposed manner the risk to the public is considered to be acceptable.

Environmental Effects

The chemical is not considered to pose a risk to the environment based on its reported use
pattern.

RECOMMENDATIONS

Control Measures

Occupational Health and Safety

? A copy of the MSDS should be easily accessible to employees.

? If products and mixtures containing the notified chemical are classified as hazardous
to health in accordance with the NOHSC Approved Criteria for Classifying
Hazardous Substances, workplace practices and control procedures consistent with
provisions of State and Territory hazardous substances legislation must be in
operation.

Environment

?The notified chemical should not be released to the aquatic environment.

Disposal

?The notified chemical should be disposed of by incineration or to landfill.

Regulatory Obligations

This risk assessment is based on the information available at the time of notification. If the
circumstances under which the notified chemical was assessed change a reassessment may be
needed. Under the Industrial Chemicals (Notification and Assessment) Act (1989) the
notifier, as well as any other importer or manufacturer of the notified chemical, have post-
assessment regulatory obligations to notify NICNAS when any of these circumstances
change. These obligations apply whether or not the notified chemical has been listed on the
Australian Inventory of Chemical Substances (AICS).

Therefore, the Director of Chemicals Notification and Assessment must be notified in writing
within 28 days by the notifier, other importer or manufacturer:

(1) Under Section 64(2) of the Act; if
- the function or use of the chemical as a component of a UV curable coating has
changed, or is likely to change significantly;
- the amount of chemical being introduced (up to 100 tonnes per annum) has
increased, or is likely to increase, significantly;
- if the chemical has begun to be manufactured in Australia;
- additional information has become available to the person as to an adverse effect
of the chemical on occupational health and safety, public health, or the
environment.

The Director will then decide whether a reassessment (i.e. a secondary notification and
assessment) is required.

No additional secondary notification conditions are stipulated.
