1 PROPOSAL TO REMOVE A CHEMICAL FROM THE AUSTRALIAN
INVENTORY OF CHEMICAL SUBSTANCES
The Director of the National Industrial Chemicals Notification and Assessment Scheme
(NICNAS) has received information on the following chemical which indicates it was
wrongly included the Australian Inventory of Chemical Substances (AICS):

Chemical Name: 2-Propenoic acid, polymer with [(hexyloxy)methyl]oxirane and
[(octyloxy)methyl]oxirane
CAS Number: 67874-32-2

Information provided to NICNAS demonstrates that this chemical was not correctly
identified at the time of its nomination and the correct identity of the chemical is:

Chemical Name: 2-Propenoic acid, 3-(C8-10-alkyloxy)-2-hydroxypropyl esters
CAS Number: 364059-77-8

The Director, NICNAS, therefore proposes to remove 2-Propenoic acid, polymer with
[(hexyloxy)methyl]oxirane and [(octyloxy)methyl]oxirane from the AICS under section
20AA of the Industrial Chemical (Notifications and Assessment) Act 1989.

This notice is directed to all persons who believe they are introducing or using 2-propenoic
acid, polymer with [(hexyloxy)methyl]oxirane and [(octyloxy)methyl]oxirane (including
products containing it). These persons may give a statement to the Director within three
months of the date of publication of this notice giving reasons as to why the chemical should
not be removed.

2 NEW CHEMICALS TRAINING WORKSHOPS
In response to the increase in new notification categories and the fact that notifiers can now
opt to use our new electronic templates ?the Notification and Assessment team will be
running each of two half-day training workshops in:
?Melbourne on Friday 12 May
(venue: The Airport Motel and Convention Centre, 33 Ardlie Street, Attwood)
?Sydney on Wednesday 17 May
(venue: Dooleys Lidcombe Catholic Club, 24 John Street, Lidcombe).

Complimentary parking available at both venues

If there is a demand, the workshops may be repeated in other states.

Program for each venue:

9.00 - 12 noon ?Morning session: Workshop 1 - Introductory
Half-day ?for new notifiers or those who wish to receive an overview of the New
Chemicals program.
Topics: Australian Inventory of Chemical Substances (AICS) searching ?chemical
identity ?exemptions ?annual reporting ?overview of notification and assessment
categories, including new categories.

2.00 - 5.00pm ?Afternoon session: Workshop 2 - Advanced
Half-day ?for new or ongoing/regular notifiers.
Topics: explanation of the use of NICNAS's electronic templates (including a "work
through" demonstration of one permit and one certificate template) 璱nformation about
what happens to your notification when it arrives at NICNAS New Chemicals, new
categories.

Participants can attend either one or both of the Training Workshop sessions.

Per person cost of each session: $120.00 (including lunch) or $200.00 for the entire day
(includes both sessions and lunch).

Training workshops also provide an opportunity to meet staff from NICNAS, especially
members of the Notification and Assessment team.

ISP (Australasia) Pty Ltd (ABN 27 000 011 923) of 73-75 Derby Street, Silverwater, NSW
2128 has submitted a standard notification statement in support of their application for an
assessment certificate for -Alanine, N-(2-carboxyethyl)-N-dodecyl-, disodium salt, compd.
with 3,4-dihydro-2,5,7,8-tetramethyl-2-(4,8,12-trimethyltridecyl)-2H-1- benzopyran-6-yl
dihydrogen phosphate (1:1). The notified chemical is intended to be used as Skin
conditioning agent for skin care products at up to 3%. Up to 1.5 tonnes of the notified
chemical will be imported per annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

Based on the available data the notified chemical is not classified as hazardous under the
NOHSC Approved Criteria for Classifying Hazardous Substances.

Occupational Health and Safety

There is Low Concern to occupational health and safety under the conditions of the
occupational settings described.

Public Health

There is No Significant Concern to public health when used in the proposed manner.

Environmental Effects

On the basis of the PEC/PNEC ratio:

The chemical is not considered to pose a risk to the environment based on its reported use
pattern.

RECOMMENDATIONS

Control Measures
Occupational Health and Safety

? No specific engineering controls, work practices or personal protective equipment are
required for the safe use of the notified chemical itself at the concentrations
introduced, however, these should be selected on the basis of all ingredients in the
formulation.

Guidance in selection of personal protective equipment can be obtained from Australian,
Australian/New Zealand or other approved standards.

? If products and mixtures containing the notified chemical are classified as hazardous
to health in accordance with the NOHSC Approved Criteria for Classifying

operation.

Disposal

? The notified chemical should be disposed of by landfill.

Emergency procedures

? Spills/release of the notified chemical should be contained with sand or other inert
materials.

Ciba Speciality Chemicals Pty Ltd (ABN: 97 005 061 469) 235 Settlement Rd, Thomastown
VIC 3074 has submitted a standard notification statement in support of their application for
an assessment certificate for ORASOL YELLOW E-3G. The notified chemical is intended to
be used as a colouring agent for printing inks. Up to 10 tonnes of the notified chemical will
be imported per annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

Based on the available data the notified chemical is not classified as hazardous under the
NOHSC Approved Criteria for Classifying Hazardous Substances.

Occupational Health and Safety

There is Moderate Concern to occupational health and safety under the conditions of the
occupational settings described based on potential adverse systemic effects. The use of
recommended controls would mitigate the risk.

Public Health

There is Negligible Concern to public health when used in the proposed manner.

Environmental Effects

On the basis of the PEC/PNEC ratio:

The chemical is not considered to pose a risk to the environment based on its reported use
pattern.

RECOMMENDATIONS

Control Measures
Occupational Health and Safety

? Employers should implement the following engineering controls to minimise
occupational exposure to the notified chemical as introduced:
- Local exhaust ventilation

? Employers should implement the following safe work practices to minimise
occupational exposure during handling of the notified chemical as introduced, and as
diluted for use in the ink products:
- MSDS should be provided to the authorised medical practitioner responsible for
health surveillance in the workplace

? Employers should ensure that the following personal protective equipment is used by
workers to minimise occupational exposure to the notified chemical as introduced,
and as diluted for use in flexographic inks:
- Protective clothing
- Chemical resistant gloves
- Chemical gloves or safety glasses
- Respirators where local exhaust ventilation is insufficient.

Guidance in selection of personal protective equipment can be obtained from Australian,
Australian/New Zealand or other approved standards.

? A copy of the MSDS should be easily accessible to employees.

? If products and mixtures containing the notified chemical are classified as hazardous
to health in accordance with the NOHSC Approved Criteria for Classifying
Hazardous Substances, workplace practices and control procedures consistent with
provisions of State and Territory hazardous substances legislation must be in
operation.

Disposal

? The notified chemical should be disposed of by:
- Via incineration in the presence of excess air. Non-recyclable waste arising from
article manufacturing sites should be dispose to landfill.

Emergency procedures

? Spills or accidental release of the notified chemical should be handled by:
Small or large spills of the notified chemical should be contained and swept up
together with a dust binding agent. Dust formation should be avoided. The spilled
product should be placed into suitable containers, which must be tightly sealed and
properly labelled. Due to the virtually insoluble nature of the notified chemical, it
should not be washed to drains, sewer system or waterways. The spill residue should
also be prevented from entering drains, sewer system and waterways.

Secondary Notification

The Director of Chemicals Notification and Assessment must be notified in writing within 28
days by the notifier, other importer or manufacturer:

Under Section 64(1) of the Act; if
- Uses/changes are proposed that lead to greater amounts being released to sewer
systems or waterways
or

Under Section 64(2) of the Act:
- if any of the circumstances listed in the subsection arise.

The Director will then decide whether secondary notification is required.

chemical is intended to be used as colorant in industrial and household cleaners. Up to one
(1) tonne of the notified chemical will be imported per annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

Based on the available data the notified chemical is not classified as hazardous under the
NOHSC Approved Criteria for Classifying Hazardous Substances.

Occupational Health and Safety

There is Low Concern to occupational health and safety under the conditions of the
occupational settings described.

Public Health

There is No Significant Concern to public health when used in household cleaning products
as described.

Environmental Effects

On the basis of the PEC/PNEC ratio the chemical is not considered to pose a risk to the
environment based on its reported use pattern and volume.

The Director of Chemicals Notification and Assessment must be notified in writing within 28
days by the notifier, other importer or manufacturer:

Under Section 64(1) of the Act; if
- the importation volume exceeds one tonne per annum notified chemical, then a
full set of aquatic toxicity data should be provided, given the uncertainty with
modelled physico-chemical results;
- a change in the manufacturing process or purity of the notified chemical
- health and/or environmental data becomes available on potential degradation
products
or

Under Section 64(2) of the Act:
- if any of the circumstances listed in the subsection arise.

The Director will then decide whether secondary notification is required.

2152 has submitted a limited notification statement in support of their application for an
assessment certificate for Synocure 892 BA 70. The notified polymer is intended to be used
as a component of two pack non isocyanate industrial coatings and industrial paints. Coatings
containing the notified polymer will be prepared by high speed dispersion and mixing then
automatically packed into containers at 50% suitable for industrial applications. The coatings
will be applied to on-site metal structures by brush, roller or spray. Less than 100 tonnes of
the notified polymer will be imported per annum for each of the first five years.

ASSESSMENT OF PUBLIC, OCCUPATIONAL HEALTH AND SAFETY AND
ENVIRONMENTAL EFFECTS

Hazard Assessment

Based on the available data the notified chemical is not classified as hazardous under the

? The following control measures should be implemented by the employer to minimise
environmental exposure during (manufacture, formulation, use) of the notified
polymer:
- The notified polymer should be kept in a closed or semi-closed system during
processing and transportation etc where possible. An appropriate organic solvent
(eg. ethanol) should be used for cleaning of the processing equipment. The
organic solvent containing residues of the notified polymer should be submitted
preferably to incineration.
- In case of an accidental spill, an appropriate inert adsorbent should be used for
decontamination. The adsorbent should be disposed of to a professional waste
removal or incineration.

Disposal

? The notified polymer should be disposed of by incineration with flue gas scrubbing or
secure land-fill.

Storage

? The following precautions should be taken by the cosmetic producer regarding
storage of the notified polymer:
- Storage in tightly closed containers of coated steel (protective lacquer) or
polyethylene at room temperature (20-25 癈)

Emergency procedures

? Accidental spills/release of the notified polymer should be handled by trained service
personal

? In case of fire use foam powder or carbon dioxide for extinguishing.


? Rinse eyes with water for 10 minutes, open eyelids forcibly

2060 has submitted a polymer of low concern (PLC) notification statement in support of their
application for a self-assessed assessment certificate for Notified Polymer in RC-49912. The
notified polymer is intended to be used as a component of automotive paints for professional
use. The notified polymer will be imported through the port of Sydney in a finished paint
product or as a resin solution. The resin solution will be formulated in Australia into finished
automotive spray paints. Up to 100 tonnes of the notified polymer will be imported per
annum for each of the first five years.
